WHEREAS, under the Court’s Scheduling Order dated November 6, 2006 (D.I. 83)
bifurcating the contract issues from the patent infringement issues, discovery on the contract
issues has been completed, and the date for tiling case dispositive motions on the contract issues
is at hand;
Vi/WHEREAS, the parties have been discussing the resolution of the litigation;
NOW THEREFORE, IT IS HEREBY STIPULATED AND AGREED, by and between
plaintiff and defendant, subject to the approval of the Court, that the date for submission of case
dispositive motions on the contract issues shall be extended from May 4, 2007, to be due E June
4, 2007. The remaining dates in the case schedule remain unchanged. i
