Stuckey, respectfully responds, as ordered by the Court on July 18, 2007 (Doc. 1326), to the Probation Department request to continue the sentencing hearing for Michael Smith as follows: Defendant Smith has no objection to the request. In connection with rescheduling the sentencing, Defendant Smith states that he intends to call two witnesses from the Denver District Attorney's Office regarding the issue of loss under the advisory Sentencing Guidelines, and it is expected that their testimony would take no more than 20 minutes total.
