Stuckey, respectfully moves this Court for an order allowing him to appear by telephone from his home in Spokane, Washington, for the hearing on his Motion to Modify Bond Pending Sentence. The hearing is scheduled for 9 a.m. on June 28, 2007, before United States Magistrate Judge Michael E. Hegarty, and Defendant Smith will be available in Spokane to call in to the Magistrate's Court for the requested telephone appearance. To fly to Denver for the hearing would be a financial burden on Defendant Smith. Assistant U. S. Attorney Matthew T.
