Smith, and respectfully requests this Court enter an order allowing the Defendant to join in the motion filed by co-Defendant Lewis to Sever Security Fraud Counts 18 Through 29 Contained in the Second Superseding Indictment. As grounds therefore, the Defendant would state as follows: 1. The Motion to Sever the Security Fraud Counts filed by the co-Defendant Lewis

and the arguments made in support thereof equally apply to the Defendant Jannice McClain Schmidt. It would be in the best interest and most efficient interest of this Court's time, counsel's time, and the prudent expenditure of Criminal Justice Act funds to allow the Defendant to join in the co-Defendant Lewis' motion. WHEREFORE, Jannice McClain Schmidt hereby requests that she be allowed to join in the co-Defendant Lewis's Motion to Sever Security Fraud Counts 18 Through 29 Contained in the Second Superseding Indictment.
