As grounds for this Motion, Plaintiff states: 1. Lead trial counsel for the Plaintiff, David Lichtenstein, is out of town during the first two

weeks of August, including August 11, 2006, and will return on August 14, 2006. 2. All counsel are available on the following dates for the status conference, and have agreed that any of these dates are acceptable: Monday August 14, 2006 after ten o'clock am; Tuesday August 15, 2006; Wednesday August 16, 2006; Thursday August 17, 2006 between eight and nine o'clock am and after four pm; Friday August 18, 2006 between eight and nine o'clock am; Monday August 21, 2006 before two o'clock pm; Tuesday August 22, 2006 between eight and nine-thirty am and after twelve-thirty pm; Wednesday August 23, 2006; Thursday August 24, 2006. 3. 4. No party will be prejudiced by the granting of the relief requested herein. A proposed form of Order is filed herewith.
