COME NOW Defendants, John L. Chadbourne, II, Rudy Fannin, Josh Benner, Mr. Lawrence, Mr. Dazey, and Mr. Steckler, by and through the Office of the City Attorney, and having been awarded costs by entry of Judgment dated September 26, 2006, hereby submits this notice and bill of costs: 1. On October 5, 2006, counsel for Defendants contacted counsel for Plaintiff to attempt

to resolve any disputes regarding costs. To date Plaintiff and Defendants' have been unable to resolve the issues regarding costs. 5. Attached hereto as Exhibit A is the City's Bill of Costs setting forth the actual and

necessary costs incurred in this case. 6. A telephonic hearing has been requested in this matter before the Clerk of the Court
