Daniel, United States District Judge, and incorporated herein by reference as if fully set forth, it is ORDERED that Defendant Brett Cook is dismissed with prejudice. It is further ORDERED that each side shall bear its own fees and costs. Pursuant to and in accordance with the Order Approving Stipulated Motion to Dismiss Prison Health Services, Inc., EMSA Correctional Care, Dr. David Neece, Dr. Donald Daeke and Correctional Services Corporation, filed on April 9, 2004, by the Honorable Wiley Y.
