2008 Summary of Significant Additions to Mail-in Violations and Infractions Schedule TEEN DRIVER Infractions/Violations Statute 14-36(c)(3) Description Violation of passenger restrictions imposed on learner's permit holders who are 16 or 17 years old. Violation of motor vehicle passenger restrictions imposed on persons 16 or 17 years old during the period six months after issuance of license (applicable to any person 16 or 17 years old whose driver's license was issued on or after 8-1-08). Preface
An infraction is a breach of a state law, regulation or local ordinance so designated by the Legislature, for which an appearance in court is usually not required and payment of the amount due by mail or in person is authorized pursuant to C.G.S. § 51-164n. An infraction is neither a crime nor an offense as defined in the penal code. The maximum fine for conviction of an infraction is ninety dollars. There is no right to a trial by jury in matters involving infractions. Unless expressly deemed an infraction, an offense for which the only sentence authorized is a fine, is a violation. C.G.S. § 51-164n designates certain violations for which an individual shall either pay the fine and additional charges or plead not guilty. There is no right to a trial by jury in any matter involving violations payable pursuant to C.G.S. § 51-164n where the maximum penalty is a fine of five hundred dollars or less. The judges of the Superior Court, as authorized by C.G.S. § 51-164m, have established a schedule of fines for infractions, and for certain motor vehicle, boating and miscellaneous violations. The Commissioner of Environmental Protection, as authorized by C.G.S. § 23-4, has established a schedule of fines for infractions which deal with breaches of regulations for the preservation and protection of parks and forests. These fines are incorporated in the "Total Amount Due" figures which are printed on the following pages. The schedule for motor vehicle infractions and violations is set up both alphabetically and numerically. If a fine for any infraction has not been established, pursuant to C.G.S. § 51164m the fine for that infraction shall be thirty-five dollars until such time as the judges of the Superior Court establish a different fine for such infraction. If a fine for any violation has not been established, pursuant to C.G.S. § 51-164m the fine for that violation shall be one hundred dollars or the maximum fine specified by statute for such violation, whichever is less. Each "Total Amount Due" figure appearing in this schedule is the sum of the fine and, where applicable, the following additional amounts established by statute: (1) C.G.S. § 51-56a(c) requires payment of an additional fee of one dollar for each eight dollars or fraction thereof of the fine for all speeding violations under C.G.S. § 14-219, for all infractions and for certain other motor vehicle violations, except that as regards infractions, such additional fee shall be only on the first eighty-eight dollars of the fine for such infraction. (2) C.G.S. § 54-143(a) requires that a fifteen dollar cost be imposed against any person who pleads nolo contendere (no contest) to, or is convicted of, a speeding violation under C.G.S. § 14-219 or a speeding infraction. (3) C.G.S. § 54-143a requires that a twenty dollar surcharge be imposed against any person who pleads nolo contendere to, or is convicted of, certain violations or any infraction, except that such cost shall be thirty-five dollars for a violation of any section of the general statutes the violation of which is deemed an infraction and carries a fine of thirty-five dollars or more. (4) C.G.S. § 13b-68 establishes the Special Transportation Fund (S.T.F.) and C.G.S. § 13b-70 requires that an additional amount equal to fifty percent of the amount of the fine be imposed against any person who commits a speeding violation under C.G.S. § 14-219 and various other violations and infractions specified in C.G.S. § 13b-59(g). This additional amount is known as the S.T.F. surcharge. (5) C.G.S. § 14-212a requires payment of an additional fee equivalent to one hundred percent of the fine established or imposed for certain infractions and motor vehicle violations committed while work is ongoing within a designated highway construction zone or within a designated utility work zone, or while activities are ongoing in a traffic incident management zone. (6) C.G.S. § 14-212c requires payment of an additional fee equivalent to one hundred percent of the fine established or imposed for certain infractions committed when a driver of a vehicle fails to grant or yield the right-of-way to a bicyclist. (7) C.G.S. § 14-212b requires payment of an additional fee equivalent to one hundred percent of the fine established or imposed for violation of C.G.S. § 14218a or C.G.S. § 14-219 when such violation is committed within a designated school zone. (8) C.G.S. § 14-295a requires the payment of an additional five dollar assessment for convictions of C.G.S. § 14-219 and for those who plead nolo contendere to a violation of C.G.S. § 14-219 and pay the fine by mail. (9) C.G.S. § 22a-250(b) requires that a surcharge in an amount equal to fifty percent of the fine for littering be imposed against any person convicted of littering on public land. (10) C.G.S. § 51-56a(d) requires that an additional fee of ten dollars be paid by each person who pays in any sum as a fine for any violations for C.G.S. §§ 14-218a, 14-219, 14-223, 14-230 to 14-240, inclusive, 14-241 to 14-249, inclu1

sive; C.G.S. § 14-279 for a first offense; or C.G.S. §§ 14-289b, 14-299 and 14301 to 14-330, inclusive. The fines established by the judges of the Superior Court for mail-in speeding violations are incorporated in the "Total Amount Due" figures which are specially printed in the charts on pages Appendix C and Appendix D herein. If a person with one or more infractions or mail-in violations wishes to pay the "Total Amount Due," payment shall be considered a plea of nolo contendere. Payment of an infraction or mail-in violation will be considered as a finding of guilty for administrative purposes only. Pursuant to C.G.S. § 51-164n, payment by the defendant cannot be used in any civil or criminal action to establish the conduct of the person making the payment, although the defendant may be subject to administrative sanctions by either the Commissioner of Environmental Protection or the Commissioner of Motor Vehicles. If a person alleged to have committed a motor vehicle infraction or violation which is payable through the Centralized Infractions Bureau elects to send payment of the fine and any additional costs (total amount due) to the Centralized Infractions Bureau, no points shall be assessed by the Commissioner of Motor Vehicles against that person's operator's license for such infraction or violation. Even though an infraction or mail-in violation will not cause automatic suspension of a driver's license or registration, it may be recorded on the motorist's motor vehicle history. If a minor wishes to pay for an infraction or for a mail-in violation, the complaint must be signed by a parent or guardian. If a person who is issued a Complaint Ticket wishes to plead not guilty, that person must sign the not guilty plea which appears on the back of the complaint and mail it to the Centralized Infractions Bureau in the envelope provided for such a purpose. A plea of not guilty will be transferred by the Centralized Infractions Bureau to the Geographical Area court location encompassing the area where the infraction or mail-in violation was committed. That court will notify the person of the date for trial. During the trial all court formalities, including rules of evidence and procedure, will apply. A defendant who fails to submit a payment or file a not guilty plea at the Centralized Infractions Bureau faces additional criminal and administrative sanctions. Any or all of the possible sanctions may be imposed against an unresponsive defendant. In all infractions matters, the defendant's failure to act constitutes the misdemeanor of Failure to Pay or Plead to an Infraction, in violation of C.G.S. § 51164r(a). A defendant can be arrested and required to appear in court, where that person will face a maximum penalty of imprisonment for up to three months and a fine of up to five hundred dollars in addition to the penalties imposed pursuant to the original infractions matter. In all matters concerning the violations specified in C.G.S. § 51-164n, the defendant's failure to act constitutes the misdemeanor of Failure to Pay or Plead to a Violation, in violation of C.G.S. § 51-164r(b). A defendant who fails to pay or plead to such a violation can be arrested and required to appear in court, where that person will face a maximum penalty of imprisonment for up to one year and a fine of up to two thousand dollars in addition to the penalties imposed pursuant to the original violations matter. If a case involves a motor vehicle infraction or violation, a defendant's inaction can also lead to a report by the court to the Department of Motor Vehicles under C.G.S. § 14-140, which may result in the suspension of the defendant's license. If the court orders action under C.G.S. § 14-140, the defendant will be required to pay a substantial fee to the clerk to open the case. If the defendant's license is in fact suspended by the Department of Motor Vehicles, that person will also be required to pay a reinstatement fee directly to that department as required pursuant to C.G.S. § 14-50b(a). If the case involves an infraction or violation under Chapter 268 of the General Statutes concerning boating, failure to respond may also result in a report by the court to the Department of Motor Vehicles under C.G.S. § 15-154. This may result in the suspension of the boat registration for up to 30 days.
