l Having reviewed Plaintiffs Motion to Dismiss Defendants' Counterclaim, the Court rules as
2 follows:
3 IT IS HEREBY ORDERED:
4 I Plaintiff has established that Defendants' Counterclaim for abuse of process fails to state a Q
5 claim and should therefore be dismissed pursuant to Federal Rules of Civil Procedure, Rule 12(b)(6).
6 Further, the Court finds that Defendants will not be able to amend their counterclaim to sufficiently
7 state a claim for abuse of process against Plaintiff.
8 Defendants' Counterclaim is hereby dismissed with prejudice.
9 IT IS SO ORDERED.
