pursuant to 42 U.S.C. § 1983, alleging that jail officials allowed him to be assaulted by
another inmate, resulting inserious injuries to plaintiff, in violation of the Eighth ‘
_ Amendment. ,
On ]uly 26, 2007, this Court issued an Order that directed defendants to file a
dispositive motion and provided that plaintiff’s opposition to defendants’ motion for
summary judgment " shall be filed with the Court and served on defendants no later
_ than thirty (30) days from the defendants’ motion," pursuant to Federal Rule of Civil
Procedure 56. V g
- _ A Defendants Sheriff’s Technician Richardson and Sheriff Gregory Ahern filed a — `
motion for summary judgment on October 24, 2007.* The grounds for the motion were
that plaintiff could not establish deliberate indifference on part of Sheriff’s Technician 1
Richardson and that Richardson was entitled to qualified immunity.
