Dear Judge Robinson:
We write in response to Richard I-Iorowitz’s letter of October 18, 2007 (D.I. 531).
Syngenta respectfully submits that there is no need to delay the scheduling ot` a conference until
the Federal Circuit decides Monsanto’s yet to be tiled motions and issues the mandate. As
Monsanto is well aware, motions for reconsideration and rehearing en banc are rarely granted,
especially when a party challenges a unanimous decision that does not involve novel issues of
law. There is no reason to delay a conference until the remote possibility of a rehearing has been
ruled out. Nor is there any reason to wait for the mandate to issue, as the appeal of the related
patent case did not deprive this Court of jurisdiction.
At the time the stay was issued, this case was on track for a January 2007 trial.
The case thus has been delayed more than nine months while Monsanto has unsuccessfully
pursued an appeal in the patent case. Even if the Court schedules a conference promptly, that
delay is likely to exceed a year. Any additional delay will be particularly harmful to Syngenta
because Syngenta not only seeks money damages, but seeks injunctive relief that is necessary to
open the markets to free and fair competition.
