COMES NOW PROBATION OFFICER Max C Richards presenting an offlclal report on Jame Brian Nardl who was
committed to the Bureau of Prisons on May 24, 2007 by the Honorable Susan R. Bolton presiding inthe District Court of
Arizona. A forty·elght (48) month period of supervised release was imposed, and supenrlslon commenced upon the offenders
discharge from imprisonment on October 3, 2007. In addition to the general terms and conditions adopted by tlie court, the
offender was ordered to comply with the following special conditions:
1. You shall paniclpete as instructed by the probation officer in a program of substance abuse treatment which may
Include testing for substance abuse. You shall contribute to the cost of treatment in an amount to be determined by
the probation officer. _
2. __ You shall submit your person, properly, (including but not limited to computer, electronic devices, and storage media),
residence, office, or vehicle to a search conducted by a probation officer, at a reasonable time and In a reasonable
manner.
3. You shall provide the probation officer access to any requested financial information.
4. You are prohlblfed from owning, maintaining or using a firearm. .
5. You shall abstain from all alcohol or alcoholic beverages.
James Brian Nardl was convicted of armed bank robbery, a Class B felony.
RESPECTFULLY PRESENTING PETITION FOR ACTION OF COURT FOR CAUSE AS FOLLOWS:
Allegatlon A: : “You shall not commlf another federal, state, or local crime during the temt
of supervisionf A grade C violation. §7B1.'I (a)(3).
Nardl introduced contraband, tobacco, Into the Federal Correction Complex In Tucson, Arizona, between October3, 2007, and
October 11, 2007. This ls evidenced by tobacco seized by prison officials and by telephone conversations recorded by prison
officials. This is a vloletlon of 1B U.S.C. 1791(d)(1)(F], a misdemeanor offense.
Allegatfon B: Vlclatlon of Standard Condition 1 : ‘You shall not commlt another federal, state, or local crlme dunng the term
of supervision? A grade C violation. §7B1.‘l{a){3).
On May 23, 2008, Nardl committed the offense dlscrdedy conduct when he attempted to assault his brother‘s girlfriend as
evidenced in Tucson Police report numbers 0805280884 and 080523081B.
