Title: EEOC v. Cigna Health Care AZ, et al. --------------------------------------------------------------------------------------------------------DOCKET ENTRY MINUTE ENTRY before Judge James A. Teilborg. Court Reporter: David German Appearances: Katherine Kruse, Michelle Marshall and Valerie Meyer for pla. John Coulter, John Ogden and Kristin Culbertson for dfts. Final Pretrial Conference held. IT IS ORDERED setting jury trial for Tuesday, October 31, 2006 at 9:00 a.m. in Phoenix, Arizona. Estimated length of trial is 3-4 days. Trial schedule discussed. The Court signs Final Pretrial Order in open court. A jury panel of 8 persons shall be selected. Each side shall be permitted 3 preemptory strikes. The Court shall proceed by the strike and replace method. Final jury instructions shall be given after closing arguments. The Court shall allow each side 45 minutes to present opening statements at trial. The Court rules on the following motions as follows - IT IS ORDERED: S granting [115] Defendant's Motion to Bifurcate Punitive Damages. If a verdict on compensatory damages is returned in favor of plaintiff, then trial on punitive damages shall proceed immediately before the same jury. S denying [116] Defendant's Motion in Limine re: Economic Damages (backpay). S denying [126] Plaintiff's Motion in Limine re: evidence of defendant's affirmative action policies and evidence related to workplace culture and diversity. S granting [125] Plaintiff's Motion in Limine re: Prohibit defendant from calling EEOC Employees as Witnesses. Exhibit Marking Instructions and trial schedule care are provided to counsel by the deputy clerk in open court.
