Chemical Lime have appealed the Court's decisions to the Ninth Circuit and BNSF is concerned about the use of privileged information during the appellate proceedings. BNSF also requests an in camera inspection because plaintiff's counsel regularly sues BNSF and other railroads. In light of the foregoing, BNSF proposes that the Court receive and review the complete, unredacted copies of the statements at issue in this litigation and return those copies to BNSF at the conclusion of the Court's review.
