1-, Plaintiff HomeTeam Pest Defense, LLC, and Defendant Pestube Systems, Inc. stipulate
18 to the following as an appropriate and reasonable method to fully resolve the issues
19 surrounding the loss of the yellow-tubing from the Gordon Dobbs February 2005 testing of
20 Tempo SC Ultra.
21 l. The parties stipulate that HomeTeam’s Count III for injurious falsehood shall be
22 dismissed with prejudice pursuant to Fed. R. Civ. P. 4l(a)(l)(ii).
23 2. The parties further stipulate that paragraphs 17 and 22 of the Complaint shall be
24 stricken from the Complaint.
25 A proposed form of order is submitted with this stipulation.
