I MOTION FOR RECONSIDERATION OF MOTION TO ENFORCE
2 SETTLEMENT AGREEMENT AND MOTION TO DISMISS PLAINTIFF’S
COMPLAINT

4 Defendant Michael Cambra ("Cambra"), hereby moves this Court for a
5 Motion for Reconsideration pursuant to Rule 59 (a)(2) & (e) of the Federal Rules of
6 Civil Procedure for Reconsideration of the Motion to Enforce Settlement Agreement
7 and to dismiss this action pursuant to Fed. R. Civ. P. l2(b)(1), 12 (b)(2) and 12
8
9 (b)(6); and Relief from Judgment or Order pursuant to Rule 60 (a) and (b). Plaintiff
10 fails to state claims for which relief can be granted and, in any event this Court lacks
11 jurisdiction to hear plaintiffs’ claims. The reasons supporting this motion are set forth
12 in more detail in the accompanying Memorandum of Law and attached exhibits.

14 THEREFORE, defendant respectfully requests that the instant motion be
15 GRANTED and that this action be DISMISSED.
