26 Respected authorities submit that pursuant to FRCP 56(c) Plaintiff is allowed to serve i

27 opposition affidavits at anytime prior to the date ofthe hearing. (Preparing for Trial In Federal
28 Court, Phillip J. Kolczynski, §65(lI)(A), 2005. Oral argument is set at this matter for November

I 21, 2005. Therefore Def`endants’ have been provided with more than a reasonable amount of time -
2 to review this critical information from Plaintiff
3 Plaintiff s Declarations, Documents, and Statements of F act were produced during, or based
4 upon documents produced during, Plaintiffs appeal for LTD lbenehts. The information contained _
5 in the Declarations constitute a patent and unequivocal showing that Defendants’ engaged in
6 arbitrary and capricious conduct to wrongfully deny Plaintiff s claim for LTD benefits. In balancing
7 the equities, Plaintiff has served a detailed and compelling declaration in support of her Opposition
8 to Det`endants’ Motion for Summary Judgment. In connection with her disabling Chronic
9 Fatigue Syndrome, Plaintiff is afflicted with debilitating and di-sabling cognitive
10 dysiiinction, which was evaluated by preeminent neurop sychologigist Sheila Bastien, Ph.D.
11 and the findings of a brain SPECT scan. Plaintiff has further testified that her health continues a
l l 12 to signiticaritlyldeteriorate, thus making it eiitremely difficult for her to assist in these proceedings.

I5 Plaintiff seeks to introduce for the first time, affidavits, documents, and Plaintiffs Statement i
16 of Facts that were not befbre the-plan administrator when it denied Plaintift’s claims for LTD
l'? benefits. Plaintiffs Afdavits, Documents and Statements of Fact were produced during, or .
IS based upon documents produced during, Plaintiffs appeal for LTD benefits. These documents on E
19 which the Affidavits are based, was information that was considered by both Defendant CNA and
20 Hewitt in upholding the decision to deny Plaintiff her LTD benefits. ·
21 Accordingly, since the postponed filing ofthese Declarations, which were filed prior to Oral I
22 Argtunent in the matter, and will not cause any harm to Defendants’ , Plaintiff respectfully requests Z
23 that the Court deny Defendants’ Objections to Plaintiffs Motion for Leave to File Supplement
24 Declaration of Stuart H. Sandhaus in Support of Opposition to Det`endants’ Motion for Summary
25 Judgment.
