As previously demonstrated, the draft document, along with instructions to complete those portions marked "Plaintiff," was mailed to Plaintiff on September 20, 2006. This document was mailed to the only address provided by Plaintiff and was never returned as undeliverable. When Defendants did not hear from Plaintiff by the Court's deadline, Defendants finalized the proposed order and served a copy of this Proposed Joint Pretrial Order upon Plaintiff at this same address.
