Dear Judge Silver:
Per the Paragraph N of the Court’s February 23, 2006 Scheduling Order, the parties
jointly submit this FIRST NOTICE OF SETTLEMENT AND DISCOVERY PROGRESS.
Settlement Progress
The parties have engaged in settlement discussions but to no avail. These efforts
continued in early January 2006.
In addition, the Meritage parties agreed to a private mediation, which Rick Hancock
agreed to but Greg Hancock rejected. The parties are committed to engaging in settlement
discussions in the future, but they do not believe that any Court intervention in the settlement
process at this time will be productive.
Discovery Progress
The parties continue to cooperate with discovery. Except for the issues related to the files
in the possession of Titus, Brueckner & Berry ("Titus documents"), which are pending before
this Court as part of a motion for an order to show cause, and Snell & Wilmer, which is subject
to a motion to dismiss, the parties believe that they can continue to resolve the disputes without
Court intervention. The parties also believe that but for the Titus documents they can complete
discovery per the Court’s February 23, 2006 Scheduling Order.
