[Doc. No. 29] Pursuant to the Notice of Settlement, the Court ordered on November 3, 2005 that a Status Hearing regarding settlement would be held on December 12, 2005 at 11:30 a.m. [Doc. No. 30] The Court further ordered that the parties had 30 days from the date of the Order to file a stipulated dismissal, at which time the Status Hearing would be vacated. Having received no stipulated dismissal, the Court held the Status Hearing. Neither party appeared at the Status Hearing. Based on the Notice of Settlement, the undersigned shall dismiss the instant case. Accordingly, IT IS ORDERED that this action is DISMISSED WITH PREJUDICE, each party to bear its own attorney's fees and costs incurred. // //
