Joseph Richard Pedro, through undersigned counsel, asks this Court to extend the deadline for filing pretrial motions in this case and continue the trial presently set for January 4, 2006. The reason for this continuance is to allow defendant to undergo psychological evaluation. Although Mr.Pedro has undergone some a partial evaluation, counsel is awaiting an order from this Court regarding approval for a more extensive psychological report. Accordingly, counsel requests a 60 day continuance. The Assistant United States Attorney assigned to this case, Thomas Simon, does not have an objection to this motion. Counsel for co-defendant, William John Harris, has no objection to this motion. Mr. Harris is currently undergoing a psychological evaluation in a Bureau of Prisons facility. It is expected that excludable delay under Title 18 U.S.C. ยง3161(h)(1)(F) and (8)(A) will occur as a result of this motion or from an order based thereon. Respectfully submitted: December 9, 2005.
