Dear Judge Martone,
I am the wife of Richard Nail. Richard was sentenced on October 30, 2006 to six
months incarceration in your court room. I do not know where to begin, only that I know I need
to express some thoughts. I do not know "sentencing" protocol due to never being exposed to
our justice system before this time. Please forgive me if this letter is inappropriate.
I would like to start by saying that I am grateful to your decision of six months of time
compared to what the prosecution and pre-sentencing board recommended. However, I am still
in shock that he received any incarceration when all along the government was leading us to

believer that if one had charges brought against them, then, well. . .they must deserve it! Alter
witnessing the bait and switch tactics of the prosecution I now believe otherwise. I am saddened
to say I now believe one is guilty until proven innocent in our legal system.
I would also like to let you know what my family observed directly alter the sentencing
was completed that has tainted my opinion of our court system. As I was reeling from shock that
our lives have now been forever changed, I glanced over to the "other” side of the courtroom.
What I witnessed there mac my stomach turn . The prosecution’s audience of supporters were
all standing and celebrating their victory. My family and I have just had our world turned upside
down for the last two years, stressed beyond belief. . .the stress possibly even igniting my
husband’s life threatening cancer, and the prosecution has the lack of professionalism of a pro
wrestling match. My mother even commented to who ever would listen that she could not
believe they were celebrating over the ruin of anotl1er’s life. From where I sit, it was all a
numbers game for the prosecution. hi my opinion, the prosecutions tactics were no less ethical
than the likes of Harvey Sloniker. The only difference is the prosecution can hide behind the
name of United States.
Again, I am grateful that you did your best in the case that was presented. I just thought
you should hear from an average American citizen that used to believe in justice.
