MOTION TO CONTINUE SENTENCING DATE (Assigned to the Hon. Frederick J. Martone)

Defendant Richard Nail, represented by Ivan K. Mathew, respectfully requests that the sentencing date in this matter be continued for 60 days. Previously the Court advised the Defendant that it would extend the sentencing date to accommodate the Defendant's medical condition. Mr. Nail received notice that the cancer treatments received earlier this year, did not eradicate all of the growth. Mr. Nail will need to undergo additional chemotherapy. As a result, additional time is requested to allow Mr. Nail to receive medical treatment. Guillermo A. Peña, Senior U.S. Probation Officer, has been advised of this Motion and has no objection to the continuance.

Underlying counsel attempted to contact Ms. Hernandez and Mr. Restaino. They are out of the office for an extended period.
