18 moves the Court for a continuance of the presently set sentencing date of October 19, 19 2005 on the following grounds: 20 1. Counsel only received the Presentence Report from Probation in this 21 22 23 24 25 matter on or about September 8, 2005. The materials were sent to Mr. Marshall on September 9, 2005. Although a meeting is currently scheduled to review the Presentence Report with Mr. Marshall, such meeting has not yet occurred. 2. Counsel is in need of additional time to review the Presentence

26 Report, meet with the client and discuss any necessary objections, and prepare any 27 needed sentencing memorandum. 28 3. This defendant is in not custody.

At the time of this filing, counsel for the Government, Timothy Duax,
