This status report is submitted in response to the court's August 11, 2005 Order. This matter was opened so that the judgment creditor, Coldwell Banker Itildo, Inc., a Nevada corporation, could proceed with post-judgment collection remedies including conducting a judgment debtor's exam of David Menken. Before the judgment debtor's exam could take place, Mr. Menken commenced a separate lawsuit against Coldwell Banker Itildo, Gerry and Maxine Emm, Marsha Tomerlin and Jim Valentine, and their Nevada attorneys, David Morandi and the law firm of Scarpello, Huss & Oshinski, Ltd., in the United States District Court, District of Arizona, Case No. CIV 04-598-PHXCase 2:03-mc-00035-FJM Document 20 Filed 08/22/2005 Page 1 of 3

MHM (hereafter the "Second Suit"). As a result, the parties voluntarily stayed any proceeding in this action pending a decision in the Second Suit. Judge Murguia entered a decision and dismissed the Second Suit by order dated June 29, 2005. The undersigned requests this matter not be dismissed, but that it be kept open or continued for an additional 45 ­ 60 days to permit Coldwell Banker Itildo, Inc. to obtain substitute counsel in order to proceed with any and all post-judgment collection remedies.
