19 An application for a Writ of Garnishment against the property Carlos A. Moe,
20 defendant, has been tiled with this Court. A judgment has been entered against the above-
21 named defendant in the amount of $24,694.06 consisting of principal, costs and accruing
22 interest. There is a balance due of $14,047.46 through December 28, 2005.
23 You are required by law to answer in writing, under oath, within ten day s, whether or
24 not you have in your possession, any non-exempt property of the defendant.
25 Pending further order of this court, you shall withhold and retain on a continuing basis
26 25% of the defendant judgment debtor's non-exempt earnings, if any, as you determine in
27 accordance with the Non—Exempt Earnings Statement form attached to the Answer of
Gamishee form provided you.

2 whether such payments are weekly, bi—weekly, monthly, or otherwise.

5 Phoenix, Arizona 85003-21 18. Additionally, you are required by law to serve a copy of your
6 answer upon the dgbjgr at: Mesa, AZ and upon the United States Attorney at Financial
7 Litigation Unit, 405 West Congress, Suite 4900, Tucson, Arizona $5701-5041.
8 Under the law, there are disposable earnings which are exempt from this writ of
9 Garnishment. Pursuant to 15 U.S.C. §1674, Gamishee is prohibited from discharging the
10 defendant from employment by reason of the fact that his earnings have been subject to
11 garnishment for any one indebtedness.
12 If you fail to answer this writ or withhold property in accordance with this writ, the
13 United States of America may petition the Court for an order requiring you to appear before
14 the Court. lf you fail to appear or do appear and fail to show good cause why you failed to
15 comply with this writ, the Court may enter a judgment against you for the value of the
16 debtor’s no11—exempt property. It is unlawful to pay or deliver to the defendant any item
17 attached by this writ.
