Plaintiff SWA Painting, Inc. ("Plaintiff’), and Defendant Golden Eagle
Insurance Company, ("Defendant"), through undersigned counsel, stipulate to an
extension of time for Plaintiff to file and for Defendant to respond to Plaintiffs
Memorandum in Support of Attorneys’ Fees Motion.
After judgment was entered in this case, Defendant filed a Notice of
Appeal. The parties anticipate that the outcome of the appeal in this case will determine
whether Plaintiff will be ultimately entitled to recovery attorneys’ fees. Given the length
and complexity of the trial court proceedings, the parties expect that Plaintiffs
Memorandum of Points and Authorities in Support of Plaintiffs Motion for Attorneys’

Fees and Defendants’ Response to the Motion for Attomeys’ Fees and Response to
Plaintiffs supporting memorandum will cause the parties to incur a significant burden
that may be unnecessary if Defendant prevails on appeal. Conversely, if Plaintiff prevails
on appeal, a supplemental Memorandum will have to be filed in order to encompass fees
expended during the course of the appeal, causing the parties to have to engage in
burdensome and duplicative proceedings. Therefore, the parties respectfully request that
the Court stay any deadlines or orders pertaining to attorneys’ fees until any appellate
proceedings are resolved.
