MARIO L. HERMAN, being first duly sworn, upon his oath, deposes and says: 1. I am an attorney of record for Counter-defendants /Cross-complainants, ANAR

ENTERPRISES, INC. and AMIT PATEL ("Anar/ Patel") in the above entitled action. I make the following declaration based upon my own personal knowledge, and if called to testify thereto, would and could competently do so. 2. In the Court's order of July 26, 2005, Your Honor invited the undersigned to

"submit a single all-inclusive affidavit of reasonable attorney's fees within 20 days of this Order." (Order, at p.3) 3. In compliance with the Court's Order, the undersigned hereby files a summary of

the hours expended by me and my Paralegal, along with the normal hourly rates that apply. The summary reflects a true and correct statement of services rendered on behalf of Anar/Patel in this matter from the month of March 2005 to the present with respect to the various issues which formed the basis of the Court's Order awarding monetary sanctions. Mario L. Herman 8.25 hours x $395.00/hour = $3,258.75
