On September 9, 2005, the Court entered Judgment against plaintiff Lexcel

Solutions, Inc. ("Lexcel"). MasterCard therefore claims these costs against Lexcel. Accordingly, pursuant to Rule 54(d), Fed.R.Civ.P. and the cost provision in the parties' License Agreement, MasterCard asks the Clerk of the Court to tax costs against Lexcel in the total amount set forth above. 3. Any objection to the amount of costs must be filed with the Clerk and

served upon counsel for MasterCard within ten (10) days from the filing and service of this Verified Memorandum. 4. I have read the foregoing document and know of my own knowledge that
