16 The undersigned Assistant Federal Public Defender hereby applies to the
17 United States District Court, in the District of Arizona for the issuance of a writ of
18 habeas corpus ad testificandum for witness, Patrick Russell Wayne, Federal Register
19 #73377-011. Undersigned counsel was notified by the United States Marshal ’s office
20 that though Mr. Wayne is currently in the United States Marshal’s custody, he is only
21 in their temporary custody on writ in a subsequent criminal case. MCSO is the
22 primary custodian of Mr. Wayne and a writ needs to be submitted to MCSO for Mr.
23 Wayne. The United States Marshal’s Office has stated that it will produce Mr.
24 Wayne for the four day evidentiary hearing. The MCSO should take note that the
23 evidentiary hearing is to be held before the Honorable Stephen M. McNamee,
26 Courtroom 605, Sandra Day O’Connor U.S. Courthouse, 401 West Jefferson,
