1 Defendant CTVT Motors, Inc. d/b/a Camelback Toyota ("Camelback Toyota"), by
2 and through its attorneys of record, hereby moves, pursuant to the Court’s Memorandum
3 Decision and Order dated August 4, 2006 (Dkt. 104), Rule 54(d) of the Federal Rules o
4 Civil Procedure, and Rule 54.2 of the Local Rules of the United States District Court for
5 the District of Arizona, for an award of reasonable attomeys’ fees in the above—captioned
6 matter.l
7 On August 4, 2006, this Court ruled Camelback Toyota was entitled to recover its
8 reasonable attorneys’ fees in defending against Plaintiff Ernest Jackson’s claims. (Order
9 dated 8/4/06 at 27-28, Dkt. 104.) Pursuant to this Order, Camelback Toyota will seek
10 attorneys’ fees in an amount not to exceed $93,00000.2 ln addition, counsel for
11 Camelback Toyota estimates it will incur an additional $3,500.00 in attomeys’ fees with
12 respect to this Motion for Attorneys’ Fees.
13 Pursuant to Local Rule 54.2(b)(2), Camelback Toyota will file a Memorandum o
14 Points and Authorities and supporting documentation within sixty (60) days of the entry o
15 judgment herein. Pursuant to Local Rule 54.2(d)(l), prior to filing those materials with

18 I Because it is unclear whether the Court’s October 29, 2007 dismissal order (Dkt. 145)
19 constitutes a "judgment" for pursues of Fed. R. Civ. 54(d) and LR Civ. 54.2, in an abundance of
caution, Camelback Toyota timely files this motion within fourteen days of the date of that Order.
20 This motion, however, is filed subject to and without waiving Camelback Toyota’s Motion to
Modify or Correct Order and Request for Entry of Final Judgment, filed this same day. ln the
21 event the Court determines this motion is premature, Camelback Toyota asks that it be deemed
22 filed on the first day it would be considered ripe or, alternatively, that it be granted permission to
reiile it.
23 2 Camelback Toyota also was awarded attorneys’ fees and expenses in relation to two
24 motions to compel discovery from Plaintiff. (Order dated 1/24/06, Dkt. 103.) Pursuant to Federal
Rule of Civil Procedure 54(d)(2)(E) and Local Rule 54.2(a), those attorneys’ tees and expenses
25 are not included in the amount of fees and expenses requested in this motion, but will be
requested by separate submission in accordance with the Court’s order.

1 the Court, Camelback Toyota’s counsel will consult with Plaintiff ’s counsel and attempt in
2 good faith to resolve all disputed issues relating to attorneys’ fees.
