COMES NOW PROBATION OFFICER Leigh Anne Gibbons presenting an official report on Kirk Patrick St. John who
was placed ori probation on June 21, 2004, by the Honorable Paul G. Rosenblatt presiding in the District Court of Arizona. A
three(3)-year period of probation was imposed. In addition to the general terms and conditions adopted by the court in General
_ Order 99-9, the offender was ordered to comply with the following special conditions:
1. You shall participate as instructed by the probation officer in a program of substance abuse treatment which may
include testing for substance abuse. You shall contribute to the cost of treatment in an amount to be determined by
the probation officer. —
2. You shall submit your person, property (including but not limited to computer, electronic devices, and storage media),
residence, ofhce, or vehicle to a search conducted by a probation officer, at a reasonable time and in a reasonable
manner.
3. You shall provide the probation officer access to any requested tinancial infomiation.
4. You are prohibited from making major purchases, incurring new financial obligations, or entering into any financial
contracts without the prior approval of the probation officer.
5. You shall abstain from all use of alcohol or alcoholic beverages.
6. You shall not possess or use a computer with access to any "on-line computer senrice" at any location (including place
ofemployment) without prior approval of the probation officer. This includes any internet service provider, bulletin board
system or any other public or private network or e-mail system.
I 7. You shall consent to the probation officer conducting periodic unannounced examinations ot your computer(s),
hardware, and software which may include retrieval and copying of all data from your computer(s). This also includes
the removal of such equipment, if necessary, for further inspection.
8. You shall consent , at the direction of the probation officer, to having installed on your computer(s), at your own
expense, any hardware or software systems to monitor your computer use. You shall submit to random computer
monitoring as directed by the probation officer, at any time, with or without suspicion you have violated the conditions
of supervision.
9. You shall not associate or conduct business with members of software piracy organizations.
Kirk Patrick St. John was convicted of Criminal Copyright Violation and Aid and Abel, a Class E felony in violation of 17 USC

restitution at a rate of $200 per month beginning 30 days from the date of sentencing (July 20, 2004).
RESPECTFULLY PRESENTING PETITION FOR ACTION OF COURT FOR CAUSE AS FOLLOWS:
Allegation A: Violation of Standard Condition No. 3: You shall report to the Probation Office as directed by the Court or
probation ofticen and shall submit a truthful and complete written report within the first live days of each month.
St. John has failed to submit Monthly Supervision Reports since January 2006. Grade C violation.
Allegation B: Violation of Order to gay $15,650 restitution at a rate of $200 per month.
St. John has not made a restitution payment since June 6, 2005. Grade C violation.
Allegation C: Violation of Special Condition No. 3: You shall pro vide the probation officer access to any requested financial
information.
St. John failed to submit requested financial information. Grade C violation.
