Under consideration is Respondent's Amended Motion to Extend, filed April 11, 2007 (#87). Movant's Motion to Vacate (#82) was served on Respondent on March 19, 2007. The Court's service Order (#84) granted Respondent 60 days from service to respond, making a response due May 21, 2007. Movant's Amended Motion sought a 60 day extension to respond. However, on April 20, 2007, Respondent timely filed its Response (#88). Accordingly, the motion to extend is moot. IT IS THEREFORE ORDERED that Respondent's Amended Motion to Extend, filed April 11, 2007 (#87) is DENIED AS MOOT. IT IS FURTHER ORDERED that Movant shall have thirty days from the filing of this Order to reply in support of his Motion to Vacate (#82).
