Upon oral motion of the defendant and the Court having review allegation D of the Petition regarding `contract for any and all office space in all districts', IT IS ORDERED dismissing allegation D in its entirety as set forth in the Petition. Defendant Glen A. Beck is sworn and testifies. Rhonda Spencer testifies further. Closing arguments. As to allegation E (special condition #3), The Court finds that the defendant's entering into a new apartment lease on 3/1/2006 and new apartment lease on 1/1/2007, without prior approval of the Probation Officer, constitutes a violation of special condition #3. The Court further finds that the defendant, by entering into these leases, incurred new financial obligations and entered into financial contracts without prior approval of the Probation Officer. The Court therefore finds a factual basis for the Court's finding that the defendant violated special condition #3.

IT IS ORDERED setting final disposition hearing, including issues regarding restitution, for Thursday, February 28, 2008 at 8:30 a.m. before Judge Teilborg. Any further memoranda to be filed by defendant or Government must be filed at least seven (7) business days prior to the hearing. Any responses are due at least three (3) business days prior to the hearing. U.S. Probation shall file a second pre-disposition report prior to the hearing. Exhibits are released back to counsel for the Government at the conclusion of the hearing. Witness and Exhibit list filed. (Time in Court: 1 Hr 15 minutes) CC: U.S. Probation
