ORDER RE-INSTATING PROBATION

A petition for probation having been filed and hearings held with the defendant and counsel present, and the defendant having previously admitted violation of special condition #1 (allegation A), IT IS ORDERED re-instating the defendant's probation for a term of FIVE (5) YEARS, to date from August 4, 2004, under the previously imposed standard conditions of probation as stated in the General Order 05-36 and the following special conditions: 1. You shall participate as instructed by the probation officer in a program of substance abuse treatment which may include testing for substance abuse. You shall contribute to the cost

of treatment in an amount to be determined by the probation officer. 2. You shall submit your person, property (including but not limited to computer, electronic devices, and storage media), residence, office, or vehicle to a search conducted by a Case 2:03-cr-00854-JAT Document 309 Filed 02/06/2008 Page 1 of 2

probation officer, at a reasonable time and in a reasonable manner.You shall provide the probation officer access to any requested financial information. 3. You are prohibited from making major purchases, incurring new financial obligations, or entering into any financial contracts without the prior approval of the probation officer. 4. You shall participate in a mental health program as directed by the probation officer which may include taking prescribed medication. You shall contribute to the cost of treatment in

an amount to be determined by the probation officer. 5. You shall reside in and successfully complete a residential treatment program for 6 months.

IT IS ORDERED dismissing the remaining allegation (allegation B) as set forth in the Petition. The defendant is released from custody of the United State's Marshal's Service. The defendant is advised of his right to appeal within 10 days. DATE DISPOSITION IMPOSED: February 5, 2008
