On October 3, 2005, the parties to the above-referenced action filed a Joint Report to the Court Regarding Disputed Areas of Discovery (CR 03-730-PHX-SRB) (the "Joint Report"). During the Court-mandated discussions pertaining to the discovery issues in this case, the parties realized that the issue of whether Rule 16 applies to sentencing had not been adequately briefed. See Joint Report, at 25 n. 7. The parties agree that supplemental briefing on this issue would be beneficial and agreed to do so. Moreover, the parties also agreed that certain issues pertaining to discovery in capital cases would also benefit from supplemental briefing. The parties agree to file supplemental briefs on or before Monday, October 17, 2005. Undersigned counsel for Angel Rivera, acting on behalf of all the Defendants in this case, and Steven C. Yarbrough, Assistant United States Attorney representing the United States, have conferred regarding the due date for supplemental briefing. Defendants have requested, and the Government does not oppose, a seven-day extension

in the deadlines for filing supplemental briefing. Accordingly, Defendants will file any supplemental briefs on the issues designated for supplemental briefing in the Joint Report on or before Monday, October 24, 2005. The United States will file its response ten days thereafter, and the Defendants will file their reply five days after that. If, because of the suppression hearings currently scheduled for October 25-28, 2005, the Government needs additional time to file a response, Defendants will not oppose said request. Wherefore, Defendants respectfully request an order from this Court (1) authorizing them to file supplemental briefing on certain issues related to capital sentencing discovery as set forth in the Joint Report, (2) that the Government's response will be due ten days thereafter, and (3) Defendants will file their reply five days after the Government's response is filed.1 RESPECTFULLY SUBMITTED this 17th day of October, 2005.
