COMES NOW PROBATION OFFICER Ariel F. Palafox presenting an official report on Juan De
Dios Martinez Jr. who was committed to the Bureau of Prisons on October 14, 2003, by the Honorable
Mary l-l. Murguia presiding in the District Court of Arizona. A 36 month period of supervised release was
imposed, and supervision commenced upon the offenders discharge from imprisonment December 1 7,
2004. On June 14, 2005, supervised release was revoked and Martinez Jr. was committed to the Bureau
of Prisons for 8 months. A 28 month period of supervised release was imposed, and supervision
commenced upon the offenders discharge from imprisonment January 25, 2006. ln addition to the
general terms and conditions adopted bythe court in General Order 05-36, the offender was ordered to
comply with the following special conditions:
1. You shall participate as instructed by the probation officer in a program of substance abuse
treatment which may include testing for substance abuse. You shall contribute to the cost of
treatment in an amount to be determined by the probation officer.
2. You shall submit your person, property (including but not limited to computer, electronic devices,
and storage media), residence, office, or vehicle to a search conducted by a probation officer, at
a reasonable time and in a reasonable manner.
3. You shall provide the probation officer access to any requested financial information.
4. You are prohibited from making major purchases, incurring new financial obligations, or entering
into any financial contracts without the prior approval of the probation officer.
5. You shall reside and participate in a community corrections centerfor 90 days, unless discharged
earlier by the probation officer.
6. You are prohibited from owning, maintaining or using a firearm.
Juan De Dios Martinez Jr. was convicted of Felon in Possession of a Firearm, a Class C Felony offense.
RESPECTFULLY PRESENTING PETITION FOR ACTION OF COURT FOR CAUSE
AS FOLLOWS:
A. Violation of Special Condition No. 5: You shall reside and participate in a community
corrections center for 90 days, unless discharged earlier by the probation officer.
On or about January 28, 2006, Martinez Jr. left Behavioral Systems Southwest in Phoenix,
Arizona, without authorization and against the rules of the facility. Martinez Jr. was terminated
from the program for absconding. Grade C Violation.
