UNITED STATES OF AMERICA DISTRICT OF ARIZONA UNITED STATES OF AMERICA, Plaintiff, v. AARON WILSON, Defendant. ) ) ) ) ) ) ) ) ) ) CR03-582-PHX-FJM MOTION TO CONTINUE DISPOSITION HEARING
Aaron Wilson moves this court to continue his disposition hearing currently scheduled for Monday, February 27, 2006 at 3:30 p.m. because a scheduling conflict has arisen for defense counsel. On Friday, February 24, 2006, Judge Campbell set a hearing on the government's motion to dismiss for Monday, February 27, 2006 at 3:00 p.m. in CR03-1167. This is a complex multi-defendant case which was set for trial on April 26, 2006. Counsel must attend the hearing and it is unlikely the hearing will be completed by 3:30. Thus, she requests that this court continue Mr. Wilson's disposition hearing. The assigned prosecutor, John V. Lopez, does not oppose this motion. It is expected that excludable delay under Title 18, U.S.C. Section 3161(h)(1)(F) may occur as a result of this motion or from the order based thereon. Respectfully submitted this 24th day of February, 2006.
