Remaining Claims: All of the remaining claims were asserted in Plaintiff
Erchonia Medical Inc.'s First Amended Complaint in CIV 02-2048-PHX-MHM filed with the Court on February 23, 2004. The following claims remain pending in this matter:

promissory note). 2. Motion to Correct Partial Judgment and Permanent Injunction on
Consent: On April 16, 2007 Plaintiff filed a motion for entry of a corrected form of judgment to correct a typographical error; namely correcting the order to clarify that Count VI of the Complaint for Conversion remains pending against Defendant Smith, rather than Count 4 as indicated in the order. This motion was granted and a Corrected Partial Judgment and Permanent Injunction on Consent were entered by the Court on April 20, 2007. 3. Basis for Jurisdiction: Plaintiff's Position: The original complaint in this matter (CIV02-2048PHX-MHM) was filed in State Court. However, this compliant was removed to Federal Court by the Defendants in that action based upon diversity of citizenship. See Docket No. 1 entered 10/16/2002. Plaintiff is an Arizona corporation and the remaining defendant, Miki Smith, is a Colorado resident. The amount in controversy exceeds the jurisdictional limit required for diversity cases. Therefore jurisdiction remains proper in this Court. The Court has supplemental jurisdiction over the remaining claims. Plaintiff reserves the right to submit a supplemental brief on the Court's jurisdiction or supplemental jurisdiction over 2

these claims in accordance with the Court's Minute Entry Order, if needed after further consultation with Defendant. Defendant's Position: Defendant has attempted to obtain a copy of the

Notice of Removal filed in this matter transferring this case from State Court to Federal

Court. However, this document is not available through the Court's electronic filing

system so Defendant requires additional time to obtain a copy of this document.

Defendant reserves the right to submit a brief on the issue of the Court's jurisdiction or
