MOTION FOR ENTRY OF CORRECTED PARTIAL JUDGMENT AND INJUNCTION ON CONSENT

On March 31, the parties submitted a stipulation for the entry of a partial judgment and permanent injunction on consent. This stipulation was filed pursuant to a settlement

reached among a majority of the parties. The Court entered the stipulated Partial Judgment and Permanent Injunction on Consent on April 9, 2007. Upon review of the Partial Judgment and Permanent Injunction on Consent the

parties have realized that this document contains a typographical error.

Specifically

paragraph 4 of the order provides, "IT IS FURTHER ORDERED that all claims asserted against Miki Smith and KMS Marketing, Inc. are dismissed without prejudice, with the

exception of Claim 2 (Breach of Contract), Claim 4 (Conversion) and Claim 8 (Breach of

Contract-Promissory Note) brought by Erchonia against Miki Smith, which are to remain

in this action."

However, upon review of the Amended Complaint, the parties have noticed that the

Conversion claim is listed as Claim VI not Claim IV. Therefore, the judgment should refer to Claim 6 (Conversion) not Claim 4 (Conversion). Plaintiffs further note that the

Settlement Agreement between the parties further referred to the dismissal of Count 6 (Conversion) rather than Count 4, further demonstrating that is a clerical error. Plaintiffs submit that this is merely a clerical typographical error and request that the Court enter a Corrected Form of Judgment fixing this error. This motion is made pursuant to Rule 60(a), Federal Rules of Civil Procedure. Plaintiffs' counsel has discussed this matter with counsel for all the other parties in this matter and they have indicated that they have no objection to this motion.
