Post Integrations, Inc. chose not to present expert testimony or evidence at trial related to the analytic dissection analysis. All parties had ample opportunity to present expert evidence at trial and in the post-trial briefing. The Court has not requested an evidentiary hearing. In any event, the presentation of evidence by only a single expert would be clearly inappropriate. See, e.g., Apple Computers, Inc. v. Microsoft Corp., 35 F.3d 1435 (9th Cir. 1994) (The Court will determine if expert testimony is necessary.)

For these reasons, Post Integrations, Inc.'s "Notice of Intent to Proffer Expert Testimony" is inappropriate, and the Court should deny the Joint Parties a new attempt to present evidence they never offered at trial or in briefing.
