I Before: Peter L. Shaw, Appellate Commissioner
Appellant’s motion for appointment of counsel in this habeas corpus appeal
is granted. See 18 U.S.C. § 3006A(a)(2)(B); Weygandr v. Look, 718 F.2d 952, 954
(9th Cir. 1983) (per curiam). Counsel will be appointed by separate order. ·
The Clerk shall serve a copy of this order on Jon Sands, Federal Public
Defender, 850 West Adams Street, Suite 201, Phoenix, Arizona 85007, who will s
locate appointed counsel. The district court shall provide the Clerk of this court
with the name and address of appointed counsel by facsimile transmission (FAX:
(415) 556-6228) within 14 days of locating counsel. If new counsel identifies
uncertiiied issues that should be raised on appeal, counsel shall include them in
the opening brief as permitted by Ninth Circuit Rule 22—l(e).

The court will not consider the pro se opening brief received on October 18,
2005. The Clerk shall serve a copy of the pro se opening brief on Sands to
transmit to new appointed counsel for whatever consideration new counsel deems
appropriate.
The new opening brief and excerpts of record are due January 23, 2006; the
answering brief is due February 22, 2006; and the optional reply brief is due T
within 14 days after service of the answering brief.
All other pending motions are denied as moot.
