Hoffman, as counsel of record for Third-party Plaintiff World Nutrition, Inc., hereby certify that after personal consultation and good faith efforts to do so, the parties have been unable to satisfactorily resolve the dispute related to World Nutrition's attorneys' fees claim. Undersigned counsel spoke with plaintiff's attorney, Paul Levine, directly via telephone on December 12, 2007 and December 24, 2007, left a voice mail for Mr. Levine on January 10, 2008 and, finally, had another direct telephone conference on March 27, 2008 about alternative resolutions of the fees issue.
