l Plaintiff has submitted its forms of Judgment in connection with the ciaims
2 against Defendants William Wong and Michelle Wong and Patrick Buehl and anticipates
3 that the form of those Judgments will be approved and will be submitted to the Court on
4 or before October 26, 2007. If they are not approved, Plaintiff will lodge the Judgments
5 with the Court on October 26, 2007. Plaintiff will thereafter submit its attorneysf fee
6 application pursuant to Rule 54, Federal Rules of Civil Procedure, and Rule 54.2, Rules
7 of Practice of the United States District Court for the District of Arizona.
8 With respect to Plaintiffs claims against Defendant World Nutrition, Inc., Marlyn
9 did BOE accept the Court’s Remittitur of damages. Therefore, World is entitled to a new
l0 trial on damages as to l\/lar1yn’s Lanham Act, Unfair Competition and Trade Liable
ll claims and l\/larlyn’s claim for punitive damages. Plaintiff requests that the Court
12 schedule a telephonic status conference to discuss whether the parties wiil be permitted to
13 conduct any addition discovery on the issues to be tried or whether the parties will be
14 limited to the disclosures and discovery already submitted.
