NOTICE is hereby given that, Global-Link Capital Markets Ltd, LLC, William J.
Herisko, and Thomas T. Emeiton, III, Defendants in the above entitled case, by their attorney,
Ronald J. I-lerisko, pursuant to FRAP Rule 4(a)(1)(B), hereby appeal to the United States Court
of Appeals for the Ninth Circuit, from an Order of Findings of Fact, Conclusions of Law, and
Order [Dkt. 509] entered in this action on June 20, 2005; and, from an Order [Dkt. 111] entered
Nov. 5, 2002, denying Det`endants’ Motion to Dismiss, [Dlct. 44].
This appeal is taken from the interim Consent Judgments entered in this action against
William J. I-Ierisko on September 26, 2006 [Dkt. 621]; and, against Thomas T. Emerton, Ill on

November 6, 2006 [Dkt. 634] in which Consent Judgments the parties expressly preserved their
right to appeal the matters herein appealed, (See Slctven v. American Trading Trcmsp. C0., Inc.,
146 F.3d 1066, 1070 (9th cir 1998) holding that a party may preserve its right of appeal in a
consent judgment.
