Instructions for completing Deposition in Proof of Will
(NHJB-2124-P) Form use. This form is used when the witness who signed the will or codicil cannot appear in court to answer questions about what happened when the document was originally signed. The form must be completed by the Notary Public who was appointed "commissioner" in the form "Motion to Prove Will by Deposition" (NHJB-2130-P). It cannot be filed until the court has granted that motion and a commissioner has been appointed. Top part of form ·COURT NAME: Enter the name of the county probate court where the document will be filed. (example: Belknap County Probate Court; Rockingham County Probate Court). ·CASE NAME: Enter the name of the deceased (example: Estate of John Adams; Estate of Susan Jones). ·CASE NUMBER: Leave blank if not yet assigned by court OR fill in case number if it is known. Main part of form The Notary Public appointed as commissioner in the "Motion to Prove Will by Deposition" (NHJB-2130-P) will ask the witness being deposed questions 1 through 7 listed on the form and write the answers given. Signature Section The witness who was deposed should sign the form on the WITNESS DEPOSED signature line. The form must be signed in the presence of the Notary Public/Commissioner who will complete the section immediately following the deponent's signature. The Notary Public/Commissioner will sign the form, enter the date their commission expires and affix their seal. Order This section will be completed by the judge once the document is filed with the court and reviewed in detail by the judge.
