Instructions for completing Fiduciary Bond
(NHJB-2137-P) Form use. This form is required when the probate court has ordered the executor, administrator, guardian, conservator or trustee to file a bond without sureties. In it, the fiduciary promises the court that he or she will replace any funds up to the amount of the bond in the case of the fiduciary's neglect or wrongdoing in fulfilling the fiduciary's duties. This bond protects the estate's beneficiaries. Top part of form ·COURT NAME: Enter the name of the county probate court where the document will be filed. (example: Belknap County Probate Court; Rockingham County Probate Court). ·CASE NAME: Enter the name of the deceased (example: Estate of John Adams; Estate of Susan Jones). ·CASE NUMBER: Leave blank if not yet assigned by court OR fill in case number if it is known. Numbered part of form 1. Principal is the executor, administrator, guardian, conservator or trustee appointed by the court. That person is liable for the estate and the bond. Also fill in the telephone number and complete mailing address with zip code for that person. If there is more than one executor, administrator, guardian, conservator or trustee, that person's name, telephone number and address information should be included in the space provided. 2. Amount of bond should be the total value of the estate unless otherwise ordered by the court. Enter the amount after the dollar sign. Paragraph prior to signature "To the judge of probate for the county of" should be followed by the name of the county where the document will be filed. Signature section Sign the form on the PRINCIPAL signature line, and date it in the appropriate space to the left. If there are two principals, both must sign and date the form. Order This section will be completed by the judge once the document is filed with the court and reviewed in detail by the judge.
