Instructions for completing Affidavit of Counsel as to Propriety of a Foreign Will/Codicil To be Admitted into Probate
(NHJB-2146-P) Form use. This form is used when a will or codicil is being probated in New Hampshire but the will or codicil was written in another state or in a foreign country. The form must be completed by an attorney who is stating that the will was properly executed according to the state or foreign laws in effect where and at the time the will or codicil was written. Top part of form ·COURT NAME: Enter the name of the county probate court where the document will be filed. (example: Belknap County Probate Court; Rockingham County Probate Court). ·CASE NAME: Enter the name of the deceased (example: Estate of John Adams; Estate of Susan Jones). ·CASE NUMBER: Leave blank if not yet assigned by court OR fill in case number if it is known. · In the first sentence, on the blank line, insert the name of the attorney who is submitting the affidavit. After "of" on the first line, enter the city/town and state where the attorney resides.

Main part of form 1. Enter the state or country where the attorney completing the form is licensed to practice law. On the first blank line, enter the name of the deceased person whose will/codicil is being filed. On the second line, enter the date of that document. On the first blank line, enter the state or country where the document was executed. On the second blank line, enter the name of the deceased person. On the first blank line, enter the name of the deceased person. On the second blank line, enter the state or country where the document was executed. If the document is self-proving, check the appropriate box to indicate under what laws the will was executed.

Signature section of form Sign the form on the ATTORNEY SIGNATURE line, and date it in the appropriate space to the left. Enter your telephone number and mailing address on the applicable lines. The form must be signed in the presence of a Notary Public or Justice of the Peace who will complete the section immediately following your signature.
