AUTOMATIC STAY -- WORKSHEETS IN SUPPORT
(Adopted pursuant to Order dated April 30, 2009)

Any motion seeking relief from the automatic stay pursuant to 11 U.S.C. § 362(d) to permit a foreclosure of encumbered residential real property, consisting of one to four living units, owned by an individual debtor shall be accompanied by LBF 4001-C, Worksheet Completed by the Mortgagee/Servicer in Support of Motion for Relief from Stay Involving Residential Real Property, unless: (a) the movant has obtained the debtor's assent to the motion prior to the motion being filed with the Court and the motion so indicates, or (b) the debtor has indicated an intent to surrender the real property that is the subject of the motion in the debtor's statement of intent filed with the Court pursuant to 11 U.S.C. § 521(a)(2). Failure to attach LBF 4001-1C to the motion may result in the motion being denied without prejudice by the Court without further consideration.
