IN THE UNITED STATES COURT OF FEDERAL CLAIMS CLEARWATER CONSTRUCTORS, INC., ) ) Plaintiff, ) ) v. ) ) THE UNITED STATES, ) ) Defendant. )
No. 01-351C (Judge Merow)
JOINT STATUS REPORT In accordance with the Court's December 26, 2007 order, the parties respectfully file this joint status report to inform the Court of the progress of settlement negotiations in this case. In November, plaintiff made a settlement offer that is still in the process of being considered by the Government. The Government's determination whether to accept the settlement offer has been delayed due to the deployment of agency counsel, Thomas Ingram, in his capacity as an Air Force Reserve officer, to Iraq. Although Mr. Ingram has made every effort to secure the agency's recommendation regarding the proposed settlement, his being in Iraq has necessarily delayed the process somewhat. Nevertheless, we anticipate that an agency recommendation regarding the settlement offer will be forthcoming soon, allowing due consideration of the offer by the settlement approval authority at the Department of Justice. Respectfully submitted, JEFFREY S. BUCHOLTZ Acting Assistant Attorney General JEANNE E. DAVIDSON Director s/Todd M. Hughes TODD M. HUGHES Deputy Director
